Should I sue Sony corporation?
I bought a camcorder a few years back. Despite minimal usage, the camera quit functioning. I discovered this after the warranty had expired, hence Sony would only offer to repair it at my expense. Recently, I found out that Sony was subjected to a class action suit involving faulty camcorders, among the list was the one I had purchased. By court order, Sony had to repair affected camcorders or reimburse those who had paid to have theirs repaired.
I’ve contacted Sony and was informed that I was eligible for the repair. Over the course of two months and about 5 different calls to them, they still have yet to send me the required documentation for sending my camcorder in for repair. This is a time sensitive matter, as they only have to comply with the court until September. Should I sue Sony for failure to comply with the class action suit? If I do, can I sue them for the price I paid for the camcorder plus court costs?
Yes,you can sue in 1 of 2 venues.First you can hire an attorney and file suit in Superior or Circuit Court.The attorney will file a summons and complaint.He wills sue for damages incurred,ie.the cost of repair or replacement of the camera,court costs,and reasonable attorney fees.In most cases if the damages are less than $5000.00 you can file in small claims court for the repair or replacement of the camera.If you file in small claims court you don’t need an attorney,you represent yourself.Take all your receipts and any evidence to support your case.The hearing is informal and you get to present your case in front of the judge.Either way you should get satisfactory results.Good Luck
